Booking Terms & Conditions

These Booking Terms & Conditions govern all reservations made through the Brainfood Guesthouse website (www.brainfoodguesthouse.com) or directly with Brainfood Guesthouse.
By making a reservation, the Guest confirms that they have read, understood and accepted these Terms & Conditions.

2. Eligibility
Reservations may only be made by persons aged 18 years or older.
The person making the reservation is responsible for:
- providing accurate booking information;
- ensuring that all guests comply with these Terms & Conditions and the House Rules;
- all payments relating to the reservation.
3. Reservations
Reservations are subject to availability.
A booking becomes legally confirmed only when:
- the booking process has been successfully completed;
- the required payment has been received within the specified timeframe;
- Brainfood Guesthouse has issued a booking confirmation by email.
Brainfood Guesthouse reserves the right to decline any booking request before confirmation.
4. Prices
All prices displayed on the website are shown in Euro (EUR).
Prices include VAT or any applicable taxes where required by Portuguese law, unless otherwise stated during the booking process.
Brainfood Guesthouse reserves the right to modify prices before a booking has been confirmed.
Confirmed reservations will not be affected by subsequent price changes.
5. Payments
Payments may be made using:
- Stripe
- PayPal
- Bank Transfer
Unless otherwise stated during the booking process, 100% of the reservation amount is payable at the time of booking.
For reservations paid by bank transfer or payment link, the quotation and payment request remain valid for 48 hours.
If payment is not received within this period, the reservation request will automatically expire and the accommodation will become available for other guests without further notice.
No security deposit is required.
6. Cancellation Policy
Unless a different cancellation policy is expressly displayed during the booking process, the following policy applies:
- Full payment is required at the time of booking.
- Cancellations made 14 days or more before the scheduled arrival date are eligible for a refund of 50% of the amount paid.
- Cancellations made less than 14 days before arrival are non-refundable.
- Failure to arrive without prior notice ("No-Show") will be treated as a cancellation on the arrival date and no refund will be issued.
Approved refunds will be processed using the original payment method whenever reasonably possible.
Refund processing times depend on the relevant payment provider.
7. Reservation Changes
Requests to modify a reservation are subject to availability.
Price differences may apply when changing travel dates, room type or length of stay.
Brainfood Guesthouse cannot guarantee that requested changes will always be possible.
8. Check-in and Check-out
Unless otherwise agreed:
Check-in: from 4:00 PM
Check-out: before 10:00 AM
Guests will receive arrival instructions before check-in.
Early check-in or late check-out may be available upon request but cannot be guaranteed.
Additional charges may apply.
9. Guest Registration and Identification
Portuguese law requires accommodation providers to register all guests with the competent national authorities.
For this reason, every guest must provide a valid government-issued identification document, such as:
- Passport
- National Identity Card
- Other officially recognised identification document
Guests may be asked to complete the registration process before arrival through an online check-in system or upon arrival at the property.
Failure to provide the required identification may result in the inability to complete the check-in process, in accordance with applicable Portuguese law.
Personal data collected for guest registration is processed in accordance with our Privacy Policy.
10. House Rules
Guests agree to comply with the House Rules available on our website and inside the property.
These rules are intended to ensure a pleasant, safe and respectful environment for all guests.
Repeated or serious violations of the House Rules may result in termination of the stay without refund where permitted by law.
11. Guest Responsibilities
Guests are expected to:
- treat the property with care;
- respect neighbours and other guests;
- keep shared areas clean and tidy;
- report any accidental damage immediately;
- ensure that only registered guests remain on the property.
Guests may be held financially responsible for damage beyond normal wear and tear.
12. Visitors
Only registered guests are permitted to stay overnight.
Visitors are permitted only with the prior approval of Brainfood Guesthouse.
The Owner reserves the right to refuse access to unauthorised visitors where necessary for security, legal compliance or the comfort of other guests.
13. Personal Belongings
Guests remain responsible for their personal belongings throughout their stay.
Brainfood Guesthouse shall not be liable for loss, theft or damage to personal property except where such loss results directly from negligence or where liability cannot legally be excluded under applicable law.
Guests are encouraged to ensure that valuable items are kept secure at all times.
14. Tourist Tax
Where required by local legislation, guests are responsible for paying any applicable tourist or accommodation tax.
Unless otherwise stated during the booking process, tourist taxes are not included in the accommodation price and must be paid as instructed by Brainfood Guesthouse.
15. Right to Refuse Service
Brainfood Guesthouse aims to provide a peaceful and welcoming environment for everyone.
To protect guests, neighbours and the property, we reserve the right, where permitted by law, to refuse check-in or terminate a stay in cases including but not limited to:
- abusive, threatening or violent behaviour;
- illegal activities;
- intentional property damage;
- repeated breaches of the House Rules;
- exceeding the maximum authorised occupancy;
- behaviour likely to disturb other guests.
Where a stay is terminated due to the guest's misconduct, refunds will generally not be provided unless required by applicable law.
16. Travel Insurance
Guests are strongly encouraged to purchase comprehensive travel insurance covering:
- trip cancellation;
- travel interruption;
- medical expenses;
- loss or theft of personal belongings;
- travel delays;
- other unforeseen circumstances.
Brainfood Guesthouse shall not be responsible for losses resulting from circumstances outside its reasonable control that prevent a guest from travelling or completing their stay.
17. Force Majeure
Brainfood Guesthouse shall not be liable for failure or delay in performing its obligations where such failure results from events beyond reasonable control, including but not limited to:
- natural disasters;
- severe weather;
- fire;
- public health emergencies;
- government restrictions;
- power failures;
- water supply interruptions;
- telecommunications failures;
- strikes or other unforeseen events.
18. Limitation of Liability
To the fullest extent permitted by law, Brainfood Guesthouse shall not be liable for indirect, incidental or consequential damages arising from the use of the website or accommodation services.
Nothing in these Terms excludes liability where exclusion is prohibited under Portuguese or European law.
19. Privacy
The processing of personal data is governed by our Privacy Policy and Cookie Policy.
Guests are encouraged to read these documents before making a reservation.
20. Governing Law
These Terms & Conditions are governed by the laws of Portugal.
Any dispute arising from these Terms shall be submitted to the competent Portuguese courts, unless mandatory consumer protection legislation provides otherwise.
21. Changes to these Terms
Brainfood Guesthouse reserves the right to update these Booking Terms & Conditions at any time.
The version published on the website at the time of the reservation shall apply to that reservation.
